A Durable Power of Attorney is a special type of Power of Attorney that remains in effect even if the Principal (the person who signed the document known as his or her Power of Attorney) becomes incapacitated; thus the power and authority of the Attorney-in-Fact (also referred to as the Agent) who was appointed by the Principal to act on the Principal’s behalf remains valid and effective because the Power of Attorney is a Durable Power of Attorney.
